Terms and conditions of participation in the market research survey competition
Participation in the market research survey competition (hereinafter: “competition”) and its implementation are governed by the following provisions:
1. Organizer
The organizer of the competition is Cint AB, Luntmakargatan 18, 1tr, 111 37 Stockholm, Sweden (hereinafter referred to as the “Organizer”).
2. Eligibility to participate
2.1 All natural persons over the age of 18 who are resident in the United States of America, have full legal capacity and a valid e-mail address are eligible to participate.
2.2 Participation in the prize draw is only possible in one's own name; participation on behalf of third parties or via prize draw machines is excluded.
2.3 All employees and family members (1st and 2nd degree) and household members of the organizer as well as affiliated companies and other participating companies are excluded from participation.
3. Participation period and conditions of participation
3.1 The participation period begins on May 29, 2024 (00:00 CEST) and ends on June 19, 2024 (11:59 CEST). The entry period for this competition is based on the Organizer's database clock.
3.2 To take part, the participant must complete the survey linked at https://www.points2shop.com/market-research-survey-competition in full, answer it truthfully and enter a valid email address at the end. By submitting the e-mail address, the participant takes part in the competition.
3.3 Each person may only take part in the competition once.
3.4 The electronically logged receipt by the organizer serves to verify compliance with the deadline. The organizer is not liable for late or incomplete receipt and cannot be held responsible for technical faults.
3.5 Participation in the competition is free of charge, with the exception of the transmission costs incurred according to the tariff chosen by the participant's mobile phone or Internet provider. The purchase of products or services is not required for participation.
4. Exclusion from the competition
The organizer is entitled to exclude or disqualify individual persons from participation, e.g. in the event of violations of these conditions of participation, the use of unauthorized aids, (attempted) manipulation and incorrect personal details. In this respect, he also reserves the right to subsequently disallow or reclaim the prize.
5 Prize draw and notification
5.1 The following prize will be drawn at random from the entries received on June 20, 2024:
$250 USD optionally as a payout via PayPal, Visa debit card or a voucher from many well-known brands.
The Organizer will send the prize by email after the winner has confirmed receipt of the prize notification (see under 5.4).
5.2 The Organizer's decisions are final.
5.3 A cash payment of the prize value or an exchange of the prize is not possible. The transfer of the prize to other persons is not permitted.
5.4 Notification of the prize will be sent by e-mail to the e-mail address provided by the winning participant. The winner must confirm receipt of the prize notification by e-mail without delay, but within seven days at the latest. Otherwise, the claim to the prize shall lapse and the organizer shall be entitled to select a new winner.
6 Liability
The following exclusions and limitations of liability apply to the organizer's liability for damages, notwithstanding the other statutory requirements for claims.
The organizer shall be liable without limitation insofar as the cause of the damage is based on intent or gross negligence.
Furthermore, the organizer shall be liable for the slightly negligent breach of essential obligations, the breach of which jeopardizes the achievement of the purpose of the contract, or for the breach of obligations, the fulfilment of which is essential for the proper execution of the competition and on the observance of which the contractual partners regularly rely. In this case, however, the organizer is only liable for the foreseeable damage typical for the contract. The organizer is not liable for the slightly negligent breach of obligations other than those mentioned in the preceding sentences.
The above limitations of liability shall not apply in the event of culpable injury to life, limb or health, for a defect following the assumption of a guarantee for the quality of a product and in the event of fraudulently concealed defects. Liability under the Product Liability Act remains unaffected.
Insofar as the liability of the organizer is excluded or limited, this also applies to the personal liability of employees, representatives and vicarious agents of the organizer and affiliated companies.
7 Miscellaneous
7.1 The organizer reserves the right to interrupt or cancel the competition at any time without prior notice and without giving reasons. The Organizer also reserves the right to make changes to the procedure, the prizes or the participation period of the competition.
7.2 The competition is subject to the laws of the United States of America, excluding the UN Convention on Contracts for the International Sale of Goods. Legal recourse is excluded.
8 Data protection
All personal data provided by the participant will be processed as described in the organizer's privacy policy, which is published at https://www.cint.com/participant-privacy-notice. The organizer is the sole controller in terms of data protection law for the processing of the participants' data. The purpose of the processing is to carry out the competition. Participants have a fundamental right to information, access, rectification, erasure, restriction of processing, data portability and objection, as well as the right to withdraw consent at any time. Participants may also lodge a complaint with a data protection authority.
